I know from trading bonds, many trades settle via Euroclear, which holds both cash & bonds in escrow until both parties fulfill their obligations. If one party fails to fulfill their obligations, the trade is not executed.
Surely the clearing houses work the same way for stocks?? If so, why are the trades being executed?

For large hedge funds they have to check with their prime broker or custodian. There is actually a lot of information on their website and beyond the Chairman there is a board (7) and representation from the Federal Reserve Districts of which there are 12 - you are right in saying that they have a lot of influence but the intent of course is to have checks and balances in place to make sure that it works - more on their site. I took out my 401k it was gushing money. Even with the losses, they? still required it be taxed. It goes against the logic of "income" if you suffer loses. The basis of the law was for an increase in value. with no increase, there should not be a tax on the return. So for pulling the money out, there was a penalty and taxes on top of the losses.
